4. Pricing and Payment

4.1 Pricing

All prices listed on our website are indicative and may vary based on project requirements. A formal quote will be provided before any work begins.

4.2 Payment Terms

  • For projects under €2,000: Full payment upfront
  • For projects over €2,000: 50% deposit to begin, 50% on completion
  • Care plans: Monthly payment in advance

4.3 Late Payments

Late payments may incur a fee of 2% per month on the outstanding balance. We reserve the right to suspend services for overdue accounts.

5. Project Process

5.1 Discovery

We will discuss your requirements and provide a detailed proposal outlining scope, timeline, and costs.

5.2 Revisions

Our standard packages include up to 2 rounds of revisions. Additional revisions may incur extra charges.

5.3 Timeline

We will provide estimated timelines for each project. Delays caused by the client (e.g., late content delivery) may extend the timeline.

5.4 Client Responsibilities

You agree to:

  • Provide necessary content, images, and information in a timely manner
  • Provide feedback within agreed timeframes
  • Ensure you have the right to use all content provided

6. Intellectual Property

6.1 Ownership

Upon full payment, you own the final deliverables including the website design and content. We retain ownership of any proprietary tools, frameworks, or code libraries used.

6.2 Portfolio Rights

We reserve the right to showcase completed work in our portfolio and marketing materials, unless otherwise agreed in writing.

7. Website Care Plans

7.1 Scope

Care plan services are outlined on our Website Care Plans page. Services not included in your plan may incur additional charges.

7.2 Cancellation

Care plans can be cancelled with 30 days' written notice. No refunds for partial months.

8. Warranties and Disclaimers

8.1 Our Warranty

We warrant that our services will be performed in a professional manner. We will fix any bugs or defects reported within 30 days of project completion at no extra charge.

8.2 Limitations

We do not guarantee:

  • Specific search engine rankings
  • Specific traffic or conversion numbers
  • Uninterrupted or error-free website operation
  • Compatibility with all future browsers or devices

9. Limitation of Liability

To the maximum extent permitted by law, Brainhouse Tech shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.

10. Indemnification

You agree to indemnify and hold Brainhouse Tech harmless from any claims, losses, or damages arising from your use of our services or breach of these terms.

11. Third-Party Services

We may integrate third-party services (e.g., hosting providers, payment gateways). We are not responsible for the availability, accuracy, or practices of these third-party services.

12. Termination

Either party may terminate a project agreement if the other party materially breaches these terms and fails to remedy the breach within 14 days of written notice.

13. Governing Law

These terms are governed by the laws of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the Irish courts.

14. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective upon posting to the website. Continued use of our services constitutes acceptance of the updated terms.
